Welcome to the Flair Airline Ltd. (Flair) Business Portal for valued agency and business customers.
The following Terms of Use apply to Flair’s Business Portal and all Business Accounts registered to the Business Portal. Flair reserves the right, at its sole discretion, to modify these Terms of Use, any feature of the Business Portal or any services provided through the Business Portal at any time by posting an update on this page or through the Business Portal.
For these Terms of Use, wherever the context so requires “you” or “user” shall mean any person who has agreed to utilize Flair’s Business Portal by providing data while registering a travel agency or other business as a Registered User. “We”, “us”, “our” shall refer to Flair. “your customer” means an individual that has purchased a Ticket through your travel agency systems or otherwise through you.
1. By selecting the “I accept the Terms and Conditions” box when you create a Business Account with Flair you are confirming that you have read and understood these Terms of Use and agree to be bound by them as may be amended by us from time to time.
2. If you have any questions about these Terms of Use you should contact Flair customer support at Agency@Flyflair.com before proceeding. Should you not agree with any of these Terms of Use, please do not register for a Flair Business Account or, if already registered, please terminate your account or otherwise refrain from using the Business Portal and/or e-wallet associated with your Business Account. Use or continued use of your Business Account confirms your agreement with and understanding of these Terms of Use.
3. You may avail the services of the Flair Business Portal including our e-wallet upon successful registration and creation of a Business Account on the Flair App or Website by entering the information requested.
4. The terms and conditions relating to the Flair e-wallet shall govern any use of the e-wallet accessible through the Business Portal and associated with your Business Account.
5. When you register for an account, you are registering with Flair Airlines Ltd., a British Columbia company with a head office at 6543-1000 Airport Road, Edmonton International Airport, Edmonton, Alberta T9E 0V3.
REGISTRATION REQUIREMENTS
6. If you are a travel agency, you must be a licensed travel agency in your jurisdiction of formation with the rights, powers and authorizations necessary to carry on activities through the Business Portal and must utilize the Business Portal to provide your customers traveling from or to destinations where Flair offers scheduled flights the option to shop for, book and purchase Flair’s flight tickets and ancillary services through your own system and contact centers.
7. If you are a travel agency, you must be an ARC, BSP and/or IATA accredited travel agency authorized to shop, book, ticket, sell and service airline fare content and related optional services, and be compliant with all applicable laws for travel agencies, all as may be modified from time to time.
8. If you are a business entity other than a travel agency, you must be an active entity duly formed in Canada or the USA for the carrying on of business, as applicable, and must utilize the Business Portal for the purposes of providing your employees, officers, directors, agents and other business partners, as applicable, (each, your “customer”) with corporate travel from or to destinations where Flair offers scheduled flights.
9. To be able to access the Business Portal, you must first register with Flair and open an account in your own name or under the name of the entity you represent. You are not permitted to act on behalf of someone else or for someone else’s benefit. By registering a corporate or other legal entity Business Account, you acknowledge that you have the power to bind the corporation or other entity.
10. It is your sole responsibility to ensure that the information you provide to us is true, accurate and complete. We carry out verification procedures and your account may be blocked or closed if we suspect that you have supplied us with false or misleading information. You are required to also inform us of any material changes to your information and to keep up to date the mandatory information provided in the registration form or held on your account.
11. As part of the registration process, you will have to choose your username and password to login. It is your sole and exclusive responsibility to ensure that your login details are kept securely and not disclosed to anyone. We are not responsible for any abuse or misuse of your account by third parties due to disclosure of your login details, whether intentional or accidental, active or passive.
12. If you suspect that your login information may have been compromised, you must inform us immediately and take appropriate action to prohibit or prevent any unauthorised access to any part of your Business Account.
13. We may perform background checks on you and request any relevant documentation at any time and for any reason, including (but not limited to) to investigate the identity of the person making use of the Business Portal.
14. Flair reserves the right to limit the number of Business Accounts permitted to be registered on Flair’s Business Portal at any given time and as such you may not be entitled to register your agency.
BENEFITS OF REGISTERING AN ACCOUNT
15. Any benefits of registering a Business Account with Flair, including commissions, rebates, promotional offers and preferential itinerary changes, which are described on or provided to you via separate links through the Business Portal, are incorporated into these Terms of Use by reference.
GENERAL TERMS OF USE
16. By registering for a Business Account with Flair and by your use of Flair’s Business Portal, you acknowledge and agree that:
(a) if any customer of yours purchases tickets in relation to a trip with a single itinerary, and as part of said purchase, your customer’s itinerary includes flights from other airlines besides Flair, you will be solely responsible and Flair will have no responsibility whatsoever for providing your customers with the notifications or services in relation to that part of your customer’s trip related to any matter relating to flights on an airline other than Flair.
(b) you will not refer any of your customers to Flair’s sales/customer service agents before taking reasonable efforts to resolve any customer service issues using your own personnel. Reissues made on your customers' tickets through Flair's sales support/customer service may be subject to an issue fee.
(c) you agree to pass on to your customers all applicable communications made by Flair received by you regarding your customers’ reservations. Further, you agree that, in the event of a
scheduled change, you shall contact your customers and ensure that your customers are informed and proper accommodations or refunds are provided.
(d) Fair shall not be responsible and has no obligation to monitor how you publish any fares on your platforms, websites, social media sites, etc.
(e) you shall employ commercially reasonable methods to detect and prevent the processing of fraudulent transactions by your customers and shall contact Flair immediately in the event that you discover or learn of any new fraudulent behavior, by sending an email to Agency@Flyflair.com.
(f) under no circumstances will you use the name, distinctive signs, trademarks, commercial names, logos or symbols that identify Flair without a prior written authorization of Flair.
17. You further agree that you will indemnify and hold Flair and its affiliates, directors, officers, employees and agents harmless against any claim, liability, loss, damages and expenses (including attorney's fees and legal costs) as a result of:
(a) any unauthorized use or infringement of any trademark, service mark, copyright, patent, trade image or copyright of third parties supplied by you in connection with your use of Flair’s Business Portal;
(b) any claim for false advertising, fraud, distortion or misrepresentation in relation to the advertisement or provision of services provided by you;
(c) defamation, actual or alleged slander against privacy or professional secrecy rights, misappropriation of trade secrets or any other right or property of third parties by you, your agents, representatives, subcontractors or employees;
(d) promotional, marketing or advertising activities created by you or on your behalf;
(e) any violation of applicable laws or regulations by you, your agents, representatives, subcontractors or employees; and
(f) any fraud, misrepresentation or other wrongful acts perpetrated by you, your agents, representatives, subcontractors, employees or your customers in relation to your use of the Business Portal or the services purchased through Flair’s Business Portal.
18. In no event shall Flair be liable for, whether based on contract, tort, warranty or any other legal or equitable grounds, for any consequential, indirect, incidental, special, punitive or exemplary damages, loss of profits or revenue, loss of data, or loss of business opportunity, damage to goodwill and reputation suffered by you and/or your customers and/or any third party, even if such damages are foreseeable and whether or not such party has been advised of the possibility thereof, arising from or related to your use of the Business Portal, your violation of these Terms of Use or Flair’s response to any violation by you of these Terms of Use.
19. You will comply with your obligations under relevant data protection laws in respect of the services to be provided through the Business Portal.
20. You expressly acknowledge and agree, and will make no claim in contradiction of such acknowledgment and agreement, that the relationship between you and Flair is of an arm’s length commercial nature, so that there is no company or work relationship between you and Flair.
21. Flair makes no representation or commitment, whatsoever, regarding the number of flights available through its Business Portal or pricing which may change at any time without notice.
TERMINATION OF AGENCY ACCOUNT AND ALL SERVICES
22. Fraudulent, fictitious, or abusive bookings are strictly prohibited and are considered booking violations of Flair standards. You will notify Flair immediately of any speculative, fraudulent or abusive booking or ticketing practices, and any use of your Business Account by unauthorized person or for any unauthorized purposes. In the event of such activity, without limiting any other available remedies, Flair reserves the right to immediately terminate any further commercial relationship.
23. If Flair determines, in its sole discretion, that you experience an unusual volume or nature of disputes and/or returns or other unwanted transactions, we may block your access to Flair’s inventory until you and Flair mutually agree to re-open such inventory in the sole discretion of each party, which discretion may be exercised unreasonably and without explanation.
24. If Flair determines that you have failed to comply with any provision of these Terms of Use, Flair may terminate your access to the Business Portal without notice.
25. Your Business Account will be terminated if there is no activity through your Business Account for a consecutive 12-month period.
26. If you wish to close your Business Account, you may do so at any time after 3 months from the date of opening of your account by sending the closure request through the Business Portal or by contacting customer support by sending an email to Agency@Flyflair.com.
27. On termination or closing of your Business Account, the terms and conditions governing Flair’s pre-payment e-wallet program will govern the closing of your e-wallet account associated with your Business Account.
GOVERNING LAW AND JURISDICTION
28. Any dispute between you and Flair will be governed by the laws of the Province of Alberta, Canada and any dispute must be resolved in the Courts of Alberta.
29. All flights booked through Flair’s Business Portal are subject to the applicable Tariff published on Flair’s website and terms of carriage specified therein and by applicable law including the Airline Passenger Protection Regulations, including limitations of liability set out therein.
